Temporary Protected Status for Venezuela

To apply for Venezuelan Temporary Protected Status (TPS) for the first time, you can follow these steps:

Check Eligibility: Make sure you meet the eligibility criteria set by the U.S. government. This includes being a Venezuelan national and being physically present in the United States since the TPS designation date. The updated TPS designation date is July 31, 2023. 

Gather Required Documentation: Collect all necessary documents, including proof of your Venezuelan nationality, evidence of continuous residence in the U.S., a police clearance letter, and two passport style photos. 

Complete Form I-821: Fill out Form I-821, Application for Temporary Protected Status, which is the main application form for TPS. You can download this form from the U.S. Citizenship and Immigration Services (USCIS) website.

Pay the Application Fee: Pay the required filing fee for Form I-821. However, if you cannot afford the fee, you may be eligible for a fee waiver. Check the USCIS website for fee waiver eligibility criteria and instructions. Today, the fee is $50.00 for the form, and $85.00 for biometrics (if you are between the ages of 14 and 79). 

File Form I-821: Mail your completed Form I-821, along with supporting documents and the appropriate fee (if applicable), to the address specified in the form’s instructions. Make sure to use certified mail or a reputable courier service to track your application.

Fingerprint Appointment: USCIS receives your application, you will receive a notice for a biometrics appointment. Attend this appointment to provide fingerprints and other biographical information.

Await a Decision: USCIS will review your application and supporting documents. If approved, you will be granted TPS status.

Employment Authorization (Optional): If you want to work legally in the U.S., you can also file Form I-765, Application for Employment Authorization, along with your TPS application. If approved, you will receive an Employment Authorization Document (EAD). Don’t forget to pay the fee for employment authorization, which is currently $410.00. 

Maintain TPS Status: Once you have TPS status, make sure to adhere to all its requirements, including renewing your status when necessary and following U.S. immigration laws.
