What’s a Mandamus?
A Mandamus is a federal court lawsuit used to compel USCIS (or another federal agency) to make a decision when your case has been unreasonably delayed.
It’s an extraordinary remedy, typically reserved for cases that are clearly approvable but stuck well past normal processing timelines.
When to Consider It
Before filing a Mandamus, check how long your type of case usually takes. You can do that here:
👉 USCIS Case Processing Times
If your case has been pending longer than the average time USCIS lists for your form and office, you may have grounds to pursue a Mandamus action.
Next Steps
If your case is delayed and you’ve already exceeded the published processing time, contact Willberg Law to discuss whether filing a Mandamus makes sense for your situation. This step can often force USCIS to issue a decision faster.
