New $100 Asylum Fee: What Applicants Need to Know

USCIS and the immigration courts have started implementing a new $100 fee requirement for asylum applicants. The rule applies both to new applications and to pending cases.

1. For Cases Pending with USCIS

If your asylum case is still pending with USCIS, you’ll begin receiving a notice requesting payment of the $100 annual asylum fee.
You can pay it directly through your USCIS account using this link:
👉 USCIS Annual Asylum Fee Portal

If you’re able, pay it as soon as possible. If you’re unable to pay right now, wait until USCIS sends you the official notice before submitting payment.

2. For Cases Pending with the Immigration Court

If your asylum case is before the Immigration Court (EOIR), the system for paying the annual fee has not yet been implemented. At this time, only the new, initial $100 asylum filing fee is active through EOIR.

If you’d like to stay proactive, you may make the annual payment through this link (at your own risk):
👉 EOIR ePay Portal

Because the courts haven’t formally adopted this system yet, there’s no guarantee the judge will accept the payment. If you decide to proceed, download and keep a copy of your receipt for your records.

Willberg Law continues to monitor updates to the new asylum fee process and will post additional guidance as soon as new procedures are confirmed.
