Special Immigrant Programs: A Path to Permanent Residency
We assist specific groups in obtaining green cards through the following program
Special Immigrant Juvenile Status (SIJS)
SIJS provides a pathway to permanent residency for minors who cannot reunite with their parents due to neglect, abuse, or abandonment. Applicants must first obtain a custody order through state court, which can either be temporary or concurrent, depending on the child’s circumstances. The court must find that reunification with one or both parents is not viable. After obtaining the court order, the child can file for SIJS with USCIS.
Humanitarian Programs: Protection from Persecution and Hardship
We offer support for those seeking protection through humanitarian programs, guiding individuals through the legal processes with care.
Temporary Protected Status (TPS)
TPS is available to individuals from countries experiencing conflict, environmental disaster, or other extraordinary circumstances. TPS grants the ability to live and work in the U.S. temporarily, though it does not lead to permanent residency on its own. However, TPS holders may apply for other immigration benefits if eligible.
Eligible countries for TPS as of 2024 include – Afghanistan, Burma (Myanmar), Cameroon, El Salvador, Ethiopia, Haiti, Honduras, Nepal, Nicaragua, Somalia, South Sudan, Sudan, Syria, Ukraine, Venezuela, and Yemen. TPS provides protection from deportation and work authorization for designated periods.
U Visa for Victims of Crime
The U Visa is designed for victims of serious crimes such as domestic violence, human trafficking, or sexual assault. To qualify, applicants must demonstrate they have suffered mental or physical abuse and are willing to assist law enforcement in the investigation or prosecution of the crime. After holding a U visa for three years, individuals may be eligible to apply for a green card.
Eligibility:
- Must have been a victim of qualifying criminal activity.
- Must have suffered significant mental or physical abuse.
- Must assist law enforcement in investigating or prosecuting the crime.
VAWA (Violence Against Women Act)
VAWA offers protection to victims of domestic abuse who are married to or are children of U.S. citizens or lawful permanent residents. Under VAWA, victims can self-petition for legal status without needing the cooperation of their abuser, ensuring safety and independence.
Asylum: A Pathway for Those Facing Persecution
Affirmative Asylum
Affirmative asylum is for individuals present in the U.S. who fear persecution in their home country based on race, religion, nationality, political opinion, or membership in a particular social group. Asylum seekers must file an application with U.S. Citizenship and Immigration Services (USCIS) and attend an interview with an asylum officer.
Key Requirements:
- Applicant must be physically present in the U.S.
- Fear of persecution based on specific grounds.
- No bars to asylum, such as involvement in persecution of others.
If granted asylum, applicants can live and work in the U.S. and apply for a green card after one year. If the asylum request is denied, the case may be referred to an immigration judge.
Humanitarian Parole: Urgent Relief for Immediate Entry
Humanitarian or Significant Public Benefit Parole for Individuals Outside the United States
Humanitarian Parole is designed to allow individuals facing emergencies to enter the U.S. for temporary reasons, such as medical treatment, family reunification, or imminent danger. Though it does not lead to permanent residency, humanitarian parole can provide temporary relief during critical situations.
Eligibility:
- Demonstrate an urgent need or significant public benefit for entering the U.S. (e.g., medical records, family reunification, or danger).
Adjustment of Status: Pathway to Permanent Residency
Application to Register Permanent Residence or Adjust Status
Adjustment of Status allows individuals in the U.S. to apply for permanent residency without returning to their home country for visa processing. Some humanitarian and special immigrant categories that may be eligible for adjustment of status include:
- Asylum applicants or Asylees
- Special Immigrant Religious Workers
- Special Immigrant Juvenile Classification
Requirements for Adjustment of Status:
- Lawful entry into the U.S.
- Eligibility through a qualifying family member or employer.
- Maintenance of lawful status, unless qualifying for a waiver.
Applicants will need to file a completed application with the USCIS, undergo biometrics, attend an interview, and await a decision on their application.
